These Terms of Use ("Terms") are a legal agreement between you and Upwan Chachra, an individual developer based in Calgary, Alberta, Canada ("SHAKA," "we," "us," "our"), governing your use of the SHAKA mobile application (the "App"). By downloading, accessing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
You must be at least 18 years old to use the App. By using the App, you represent that you are 18 or older. The App is not intended for and may not be used by anyone under 18.
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices that you own or control, for your personal, non-commercial use, in accordance with Apple's App Store Terms of Service.
SHAKA is a calorie and nutrition tracking app that uses AI to identify foods from photos and text and estimate their nutrition, lets you log meals and weight, and tracks your goals and streaks. Features may change, be added, or be removed over time.
SHAKA offers an optional premium subscription, purchased through Apple's In-App Purchase and managed via RevenueCat.
You agree to provide accurate information, keep your login credentials secure, and use the App only for lawful purposes. You agree not to: misuse, overload, or attempt to disrupt the service or its AI features; reverse engineer, decompile, or attempt to extract source code except as permitted by law; access the service through automated means or scrape it; or use the App to violate any law or the rights of others.
You retain ownership of the data and content you submit, such as food logs and photos. You grant us a limited license to process that content solely to provide the App's features — for example, sending a meal photo to our AI provider for analysis — as described in the Privacy Policy. You are responsible for the content you submit.
The App, including its design, code, and branding, is owned by us and protected by intellectual-property laws. Except for the license granted above, we reserve all rights. You may not copy, modify, distribute, or create derivative works from the App without our permission.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT NUTRITION ESTIMATES WILL BE ACCURATE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM YOUR RELIANCE ON NUTRITION ESTIMATES OR YOUR USE OF (OR INABILITY TO USE) THE APP. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR CAD $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify and hold us harmless from claims, damages, and expenses arising out of your misuse of the App or your violation of these Terms or any law or third-party right.
You may stop using the App and delete your account at any time (Settings → Delete Account). We may suspend or terminate your access if you violate these Terms or misuse the service. Provisions that by their nature should survive termination — including disclaimers, limitation of liability, and governing law — will survive.
We may update these Terms from time to time. We will update the "Last updated" date and, where appropriate, notify you in the App. Continued use of the App after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. You agree that the courts located in Calgary, Alberta will have exclusive jurisdiction over any dispute, except where applicable law gives you the right to bring a claim in your local courts.
